Welcome to BloomHer (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of the BloomHer website, products, and services (collectively, the “Services”). By visiting our site, creating an account, or placing an order, you agree to these Terms and our Return Policy and Privacy Policy. If you do not agree, please do not use the Services.

1) Eligibility

  • You must be 18 years or older (or the age of majority in your jurisdiction) to purchase.

  • You are responsible for ensuring your account information is accurate and kept up to date.

2) Products, pricing, and availability

  • We aim to display product colors, images, specifications, and prices accurately. Minor differences may occur due to screen settings or supplier updates.

  • Prices may change without notice. We may correct errors, inaccuracies, or omissions (including after an order is submitted) to the extent permitted by law.

  • Quantities may be limited. We may discontinue any product at any time.

3) Orders & payment

  • Submitting an order is an offer to buy the products listed. We may accept or reject any order at our sole discretion (e.g., suspected fraud, stock issues, pricing errors).

  • You authorize us (and our payment processors) to charge your selected payment method for the total amount shown at checkout, including shipping, taxes, and fees.

  • If your payment method fails, we may cancel or place your order on hold until the issue is resolved.

4) Shipping & delivery

  • Shipping timelines shown at checkout are estimates, not guarantees. Delays can occur due to carrier issues, weather, customs, or high order volumes.

  • Risk of loss passes to you when the carrier takes possession of the shipment. Please review our Shipping Policy for full details.

5) Returns & refunds

  • Returns, exchanges, and refunds are governed by our Return Policy (incorporated by reference).

  • Do not return items to the manufacturer. All returns require a prior RMA from BloomHer.

6) Promotions, bundles & gift cards

  • Coupons, promotions, and bundles may be subject to additional terms, including expiration dates, non-transferability, and limits.

  • Gift cards are non-refundable and not redeemable for cash unless required by law. Lost or stolen cards will not be replaced.

7) Reviews & user content

  • If you submit reviews, comments, photos, videos, or other content (“User Content”), you grant BloomHer a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, translate, and display such content in any media for marketing or operational purposes.

  • You represent and warrant that your User Content is accurate, does not infringe third-party rights, and complies with these Terms. We may remove or moderate User Content at our discretion.

8) Prohibited uses

You agree not to:

  • Violate laws or infringe intellectual property, privacy, or publicity rights;

  • Upload malware, interfere with site security, or attempt to access non-public areas;

  • Engage in fraudulent activities, scraping, or resale without written permission;

  • Post unlawful, defamatory, harassing, or obscene content.

9) Intellectual property

  • All site content—text, graphics, logos, images, product names, videos, code, and designs—is the property of BloomHer or its licensors and protected by applicable laws.

  • You may not copy, distribute, modify, or create derivative works without our prior written consent.

10) Third-party services

  • We may link to or use third-party tools (e.g., payment processors, review platforms, shipping carriers). We are not responsible for third-party sites, terms, or policies. Please review them independently.

11) Warranty disclaimer

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow limitations on implied warranties, so these limitations may not apply to you.

12) Limitation of liability

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOOMHER AND ITS OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services or purchase of products.

  • Our total liability for any claim will not exceed the amount you paid for the product that gave rise to the claim.

13) Indemnification

You agree to indemnify and hold harmless BloomHer from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Services.

14) Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, strikes, war, terrorism, epidemics, supply chain disruptions, or carrier failures).

15) Governing law & disputes

  • These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules (modifiable upon request).

  • Venue: State and federal courts located in Delaware shall have exclusive jurisdiction.

  • Class action waiver: To the extent permitted by law, disputes must be brought on an individual basis; class, consolidated, or representative actions are not allowed.

  • Jury trial waiver: You and BloomHer waive any right to a jury trial to the extent permitted by law.

16) Changes to the Terms

We may update these Terms at any time. The “Last updated” date reflects the latest version. Material changes will apply prospectively. Your continued use of the Services after changes are posted constitutes acceptance.
